Which drivers are covered

A driver is generally a "covered employee" under FMCSA 49 CFR Part 382 if they operate a commercial motor vehicle that requires a CDL. This typically includes vehicles with a GVWR of 26,001 lbs or more, vehicles designed to transport 16+ passengers, and vehicles transporting placardable hazardous materials.

Required testing situations

Pre-employment

A negative DOT drug test result is generally required before a driver first performs a safety-sensitive function.

Random

Drivers must be in a random testing pool that meets FMCSA's minimum annual random testing rates.

Post-accident

Required after certain DOT-recordable accidents — typically those involving a fatality, citation plus injury, or citation plus tow-away.

Reasonable suspicion

Triggered when a trained supervisor observes specific indicators of drug or alcohol use.

Return-to-duty & follow-up

Required after a driver completes the return-to-duty process with a Substance Abuse Professional (SAP).
